Birth Log Terms of Service
Effective date and last updated: November 5, 2026
These Terms of Service ("Terms") govern your use of Birth Log (the "App"), operated by Force Coefficient LLC ("we", "us", or "our"). Your agreement for use of the App is with Force Coefficient LLC. Google Play and the Apple App Store have separate terms governing their store services and transactions.
Please read these Terms before using the App. By using the App, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the App. Nothing in these Terms limits rights or protections that applicable law does not allow you to waive.
1. Purpose and Eligibility
Birth Log helps labor and delivery nurses and other healthcare professionals keep personal records of deliveries, view summaries, and import or export delivery records. The App is intended for adults who can enter into a binding agreement. You are responsible for obtaining any employer or institutional permission required for your use.
2. License to Use the App
Subject to these Terms and any applicable purchase terms, we grant you a limited, nonexclusive, nontransferable license to install and use the App on devices you own or control for your lawful personal or professional tracking purposes. We and our licensors retain ownership of the App, including its code, design, branding, and other intellectual property. You retain your rights in the records you create.
You must not resell or redistribute the App, remove ownership notices, circumvent security controls, interfere with its services, or use it unlawfully. You must not reverse engineer the App except where applicable law permits it. Third-party and open-source components remain subject to their respective licenses; these Terms do not restrict rights granted under those licenses.
3. Professional Use and Patient Confidentiality
The App is a personal tracking tool. It does not provide medical advice, diagnosis, treatment, clinical decision support, or emergency services. It does not replace professional judgment, your employer's documentation requirements, or an official medical record. Do not rely on its summaries or counts for patient care, billing, credentialing, or regulatory reporting without independently verifying them.
Do not enter patient-identifying information or protected health information into the App, including in notes or exported files. Names, exact dates, locations, and other details may identify a patient when combined, even if direct identifiers are omitted. Record only information you are authorized to record and that cannot reasonably identify a patient.
You are responsible for following applicable privacy laws, professional duties, and workplace policies, including HIPAA where applicable. We do not offer a business associate agreement for Birth Log or represent that the App is suitable for storing protected health information. These responsibilities do not exclude any legal obligations that apply to us.
4. Your Records, Device Security, and Backups
In the public Birth Log version, delivery records are stored locally on your device, and no App account is required. We do not provide cloud backup or synchronization of those delivery records. Limited usage and device information is transmitted to Firebase as described in the Birth Log Privacy Policy.
You are responsible for the accuracy of your entries, protecting access to your device, and maintaining appropriate backups. Losing or replacing your device, clearing App data, uninstalling the App, or a software failure may cause records to be lost. We generally cannot recover delivery records stored only on your device.
Export lets you save delivery records as a CSV file to a location you select. Protect exported files and check that an export is complete and usable before relying on it as a backup. Import can replace existing delivery records; back up your current records first and use only compatible files you trust. Deleting records or uninstalling the App does not delete exported files, device backups, or copies held elsewhere.
5. Privacy
Our Privacy Policy explains how information is handled and how to contact us about privacy. These Terms do not constitute consent to processing that requires separate consent under applicable law. Please avoid sending patient information in support messages.
6. Prices, Purchases, and Refunds
Any price for downloading the App is displayed by the app store before purchase. Payments, taxes, receipts, and store transaction procedures are handled under the applicable store's terms. These Terms do not by themselves authorize a subscription or recurring charge. Any future paid offering will require separate, clear pricing and any consent required by law.
For a store purchase, you may use that store's refund process or contact us for assistance. Store procedures do not replace any claim or remedy you have against us under applicable law. Any mandatory cancellation, withdrawal, conformity, repair, replacement, price-reduction, or refund rights remain available.
If you are a consumer in the European Economic Area or the United Kingdom, a statutory withdrawal period may apply to a digital-content purchase. Any loss of that right when supply begins requires the express consent, acknowledgment, and other steps required by law. Merely accepting these Terms does not waive that right.
7. Updates and Availability
Device and operating-system compatibility requirements are shown in the app store. Some functions, including update checks, require an internet connection, and your provider may charge for data use. Install available updates and keep your operating system supported.
We may update the App to fix problems, improve security, support operating-system changes, or improve its features. We do not promise uninterrupted availability or compatibility with every future device or operating system. We will provide updates, notice, continued access, or remedies to the extent required by applicable law. Where reasonably practicable, we will give advance notice of a material reduction or discontinuation and an opportunity to export records.
8. Third-Party Services
The App uses services provided by third parties, including Firebase and the app stores. Their services may be subject to separate terms and privacy policies. We remain responsible for our own obligations under these Terms and applicable law.
9. Warranties and Responsibility
We will exercise reasonable care and skill in providing the App. Except for our express commitments and warranties or guarantees required by law, the App is provided "as is" and "as available" to the extent permitted by law. We do not guarantee that it will be free of every error or meet every individual need.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited. Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the agreement was made. We remain responsible for losses for which applicable law makes us responsible, including applicable rights concerning faulty digital content.
10. Ending Use
You may stop using the App at any time. Export any records you wish to keep before uninstalling it. We may end your license for a material breach of these Terms, subject to applicable law. Where practical, we will explain the breach and allow a reasonable opportunity to remedy it before ending the license, unless immediate action is necessary to address unlawful activity or a serious security risk. Ending use does not remove accrued rights or any refund or other remedy required by law.
11. Changes to These Terms
We may revise these Terms to reflect changes in the App, legal requirements, or our operations. We will post the revised Terms here and update the date above. For material changes, we will provide reasonable advance notice through the App or another appropriate channel where practicable, and obtain consent when required by law. Changes will apply prospectively and will not remove rights arising before they take effect. If you do not agree to a change, you may stop using the App and retain any remedies required by law.
12. Applicable Law, Complaints, and Disputes
These Terms are subject to applicable law, including mandatory consumer protections in your country of residence. If you have a problem with the App, contact us using the details below so we can try to resolve it. You may also use any complaint, dispute-resolution, or court process available under applicable law. These Terms do not require arbitration or restrict your right to bring a claim in a court available to you under applicable law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. No provision will be interpreted to remove a mandatory consumer right.
